Nationale Entscheidungen und Hinweise (NEH) Auf der 59. Sitzung des Ausschusses für das Harmonisierte System ist am 22. März 2017 entschieden worden, dass ein dreilagiges Erzeugnis (Verbunderzeugnis) aus einer oberen Lage aus einem Gewebe, einer mittleren Lage aus einer Kunststofffolie und einer unteren Lage aus einem Gewebe bzw. einem Gewirke (anderes als solches der Position 6001) als laminiertes Erzeugnis der Position 5903 anzusehen ist. Diese Einreihung hat unabhängig davon zu erfolgen, ob die mittlere Lage (Kunststofffolie) mit bloßem Auge wahrnehmbar ist oder auch nicht, da die Anmerkung 2 a) 1 zu Kapitel 59 auf laminierte Erzeugnisse nicht anwendbar ist. Die Waren können zum Beispiel wie folgt aussehen und sind u.a. zur Herstellung von so genannten Soft-Shell Jacken bestimmt:
1. Als „Kabel aus synthetischen oder künstlichen Filamenten" im Sinne der Positionen 5501 und 5502 gelten ausschließlich Kabel, die aus einem Bündel parallel liegender Filamente von einheitlicher und gleicher Länge wie die Kabel bestehen und folgenden Bedingungen entsprechen: a) Länge des Kabels mehr als 2 m; b) Zahl der Drehungen des Kabels weniger als 5 je Meter; c) Einzeltiter der Filamente weniger als 67 dtex; d) Kabel aus synthetischen Filamenten müssen verstreckt sein, d. h. sie dürfen nicht um mehr als 100 % ihrer Länge dehnbar sein; e) Gesamttiter des Kabels mehr als 20 000 dtex (RV E5501100). Kabel mit einer Länge von 2 m oder weniger gehören zu Position 5503 oder 5504 (RV E5501200).
