Oktober 2010 hat das Finanzgericht Berlin-Brandenburg entschieden, dass gekochte, getrocknete Leinsamen, die zur Pferdefütterung bestimmt sind, in die Codenummer 1204 00 90 00 0 (Leinsamen, auch geschrotet, andere (als zur Aussaat)) einzureihen sind. Den rohen Leinsamen wird 5 bis 10 % Wasser zugesetzt. Anschließend erfolgt eine Infrarot-Strahler-Erwärmung auf ca. 130 °C innerhalb von 20 bis 30 Sekunden. Dadurch wird das Produkt entbittert, die Haltbarkeit wird verbessert und die Verwendung erleichtert. Die organoleptische Prüfung durch das Gericht hat gezeigt, dass die in Frage stehenden Leinsamen den rohen Leinsamen ähnlicher sind als den gerösteten. …

1. Zu Position 1207 gehören insbesondere Palmnüsse und Palmkerne, Baumwollsamen, Rizinussamen, Sesamsamen, Senfsamen, Saflorsamen, Mohnsamen und Sheanüsse (Karitenüsse). Zu dieser Position gehören jedoch nicht Waren der Position 0801 oder 0802 und Oliven (Kapitel 7 oder Kapitel 20) (RV E1201000). 2.
